Hereinafter our General Conditions of Sale on which all the services we provide are based on www.sindbadshop.fr. At https://www.sindbadshop.fr, we offer personalized shopping and service that meet your specific interests and needs. On https://www.sindbadshop.fr

1. APPLICATION FIELDS.

1.1 These Terms and Conditions apply to all orders placed by consumers on https://www.sindbadshop.fr.

1.2 You acknowledge having read, before sending your order, these General Conditions of Sale and have communicated all the information listed in the law 31-08 on consumer protection. The validation of your order constitutes acceptance without reservation of these General Conditions of Sale.

2. CONCLUSION OF THE CONTRACT AND DELIVERIES

2.1 In the case of orders for items https://www.sindbadshop.fr , your co-contractor is SINDBAD SHOP LLC.
2.2 The essential characteristics and the price of our products are indicated on the pages containing the detailed description of the products of the online store. The «confirm order» button allows you to confirm your order which then becomes final, and a sales contract is thus concluded. We will confirm receipt of your order by email. Please note that the delivery of the ordered products is made against advance payment (reservation) in the case of payment by bank transfer. Therefore, we ask you to proceed to the payment of the sale price without delay and at the latest within 3 days of receipt of our order confirmation.

2.3 We reserve the right to assign your purchase claim to third parties. In such a case, you agree to make the payment directly to this third party on simple information from us and to collaborate with this third party for the recovery of the sale price.

2.4 We deliver the goods within the period indicated in the summary of your order. In the case of express delivery, the delivery times are different (cf. point 3.3). The delivery period runs from receipt of your payment. If we are prevented from making the delivery by an event of force majeure or a fortuitous event, the delivery period is extended according to the duration of the impediment.

2.5 We draw your attention to the fact that we are exempt from delivering the ordered goods if we have placed an order for the goods in due form but have not been supplied in due time by our suppliers. The exemption from delivery also requires that the unavailability of the goods is not attributable to us, that we have not expressly agreed to bear the risk of supply and that we have informed you of the unavailability of the goods as soon as possible. When the above conditions are met, the order is cancelled and we will refund the sums you have already paid.

2.6 Our obligation to deliver is limited to goods that we have in stock or that we have ordered from our suppliers.

3. PRICE, SHIPPING AND EXPRESS DELIVERY

3.1 The products are invoiced on the basis of the prices indicated in the offer at the time of the order. The prices indicated are the final prices, all taxes included at the legal rate in force. The goods remain our property until full payment of the sale price.

3.2 The prices of the products displayed on www.sindbadshop.fr are exclusive of delivery costs. Depending on the amount of your order or the delivery method you have selected, delivery costs may be charged (cf. 3.3 and 3.4).

3.3 Once the delivery has been made, you are obliged to check immediately whether the delivery is complete and whether the goods are damaged. Any complaints must be sent without delay to the transport company. You must also ensure that the goods delivered correspond to your order. 4. PAYMENT

4.1 We accept the following payment methods: bank transfer, credit card. Depending on each order, we reserve the right not to offer certain payment methods or to offer others. Any costs related to your payment are at your expense.

4.2 In the case of a credit card purchase, your account will be debited on the day your order is shipped.

4.3 You agree to receive invoices and invoices to have only in electronic form.

5. USE OF DISCOUNT VOUCHERS

5.1 Discount vouchers are only distributed free of charge as part of promotional actions. They have a expiration date, cannot be purchased and are not transferable.

The difference between the amount of the voucher and the price of your order can be paid by any means of payment offered. The credit materialized by the voucher is not refundable and does not generate interest. In case of total or partial return of the goods, the part of the price paid by discount voucher will not be refunded.

5.4 To apply a voucher to an order, you must enter the voucher code before sending the order. The application of vouchers to orders already sent is excluded. Unless otherwise stated, it is not possible to combine several coupons.

5.5 If you used a discount voucher during your purchase, we reserve the right to charge you the non-reduced price of the goods when, due to a partial withdrawal, the total amount of the residual order is less than or equal to the value of the voucher.

6. USE OF GIFT VOUCHERS

6.1 Gift certificates are vouchers that you can purchase. Gift Certificates can only be used for the purchase of items www.sindbadShop.fr, other gift certificates are excluded. You can pay the possible difference between the amount of the gift voucher and the price of your order by any means of payment offered.

6.2 In order to redeem the voucher, you must enter the voucher code before sending your order. Having materialized by gift certificates is not productive of interest and cannot be refunded.

You can credit the value of a gift certificate to your customer account or view the balance of your customer account by accessing the "my gift certificates" section at www.sindbadshop.fr.

7. LEGAL RIGHT OF WITHDRAWAL WHEN PURCHASING AN ARTICLE www.sindbadshop.fr.

When purchasing items www.sindbadshop.fr you have a legal right of withdrawal.

Please note that for any return of merchandise, you can use the return label that is attached to your order or that you can edit from your customer account. If you do not have a printer, have trouble downloading the return label or need a new label, you can contact our customer service department, whose contact details are below. In order to avoid unnecessary costs, please do not return the goods without the return label.

7.1 Information on the right of withdrawal:

You have the right to withdraw from this contract without giving a reason within 7 days. The withdrawal period expires seven days after the day on which you, or a third party other than the carrier and designated by you, physically takes possession of the good or the last good in case of partial delivery.

To respect the withdrawal period.

1. you must send us your declaration of withdrawal before the expiry of the said period.
2. Products must not have been used, opened or damaged;
3. Products must be returned intact and unused in their original packaging. If necessary, the packaging must retain the original seal.
4. It must not be a sale item.

7.2 Exception to the right of withdrawal

In accordance with the article of the Consumer Protection Act 31-08, the legal right of withdrawal is excluded in the case of sealed items that have been opened after delivery and cannot be returned for health or hygiene reasons. The right of withdrawal is also excluded in the case of sale item.

7.3 Effects of the withdrawal

In the event of a valid withdrawal, we will refund all payments received from you without delay and no later than fourteen (14) days from the day we became aware of your withdrawal statement. We will process the refund using the same payment method you used, unless we expressly agree to a different payment method. The refund is free of charge to you. We reserve the right to delay the refund until we have received the goods or until you have provided proof of shipment of the goods, the date being the first of these events.

You must return or return the goods to us without delay and, in any event, within fourteen days at the latest from the day on which you have communicated your declaration of withdrawal.

This period is respected if you ship the goods before the expiry of the period. The return costs are at your expense.

8. REIMBURSMENT.

Any refund from us will be made to the account you used to make the payment. In case of payment by bank transfer, the amount is returned to the account from which the transfer was made. If you paid by credit card, the amount will be refunded to the bank account linked to this payment method. In case of payment by gift certificate, we credit your customer account with the corresponding amount.

9. MODERATON OF REVIEWS.

www.sindbadshop.fr is not subject to a general obligation to monitor comments posted on the platform www.sindbadshop.fr. Nevertheless, www.sindbadshop.fr makes a moderation of the reviews published on the platform www.sindbadshop.fr to ensure their lawfulness and probity.

To do this, www.sindbadshop.fr moderating such reviews a. before they are published; b. then, if they have been published, when they have been reported by a user.

In this context, www.sindbadshop.fr reserves the right not to publish notices and/or to delete them at any time if these comments a. violate the applicable legal and regulatory provisions, and in particular, constitute manifestly unlawful content (e.g., abusive, denigrating, violent, racist, infringing); b. do not relate to a shopping experience on the www.sindbadshop.fr platform; c. violate a person’s privacy; d. are not understandable; e. encourage the purchase of products from a competing website;

10.3 Sales made through www.sindbadshop.fr are subject to the conditions of the legal guarantee of conformity provided for in Articles L. 31-8 of the Consumer Code.
